unfortunately you may be out of luck..i know a homebuilder who recently filed bankruptcy..he sold an entire neighborhood of 400k homes promising to build a pool with club house...the judge decided he didn't have to do it bc of his financial struggles..not saying this is right or fair, but it's the way it is sometimes...
