Without knowing very much about your financials, my general thoughts would be to wait.It sounds like you would be in a very hard place if you encountered unexpected repairs, if there was an extended vacancy, or any other problems from a laundry list of other possibilities.

The reason I think newbies should get lending lined up ahead of time though is because I've encountered too many newbies who are shocked at just what it takes to get a loan.

Has anyone encountered this issue before and how did you deal with it?  

I messaged a local escrow officer and he said we would need her to become his legal guardian, and get court authorization to sell.Has anyone encountered a similar situation?

To that person that told you to get out of their house, you may not want to call them again but keep them on your 'regular' mailing list and your first follow up after that awkward encounter should be something personal.
