I have built up my holdings to 5 apartment complexes and 4 single family currently in NE Ohio and sold all my pricey San Diego RE that doubled in value since first purchase in 2011 and 1031 exchanged for greater cash flow.I love this stuff!!

If he's financially tight, as some have suggested he probably is, he might just sign and walk away with the check in lieu of a dragged out battle he surely doesn't want.I would definitely have an attorney manage the exchange.

if you go this route and happen to run past the 5 year look back so you no longer qualify for sec 121 you would still qualify for a 1031 tax deferred exchange.

My brother might want to do the same, and to take cash out.We just realized that since we are receiving the proceeds to the LLC, the 1031 exchange most likely has to be done by the LLC.If this is the case, is there any way for each of us to have our own 1031 investments from here, or must we share how we invest from hereon out, with the proceeds of our sale?
