This sounds like a pretty straightforward issue to me -- it seems like this will functionally be an "interfamily transfer" due to the relationship between your brother and your grandmother.   

If they are not licensed it will be hard to prove in court that they should take the full responsibility for failed work.

Once again, I’m not a lawyer and if this went to court the magistrates could go either way...But it sounds like they conceded that money to you by their own choice.

I did contact a lawyer, he suggested doing it alone in case the tenant comes up with the rent money at court date and by law i am obligated to let him stay.

If a tenant says they are temporarily furloughed because of the virus and short on money, you will have to make a judgment call on how to proceed, knowing that courts will probably not look favorably on you in an eviction hearing.

Most places evictions are put on hold and courts are postponed for the time being so their may not be anything you can do about it if you wanted to.

Courts are closed, no evictions, tenants must comply with Open Hours clauses, etc.
