On that note, I concur with @Joe Splitrock about the lifestyle my tenants lead versus my own.I saw a sticker in a municipality's clerk's window once: "lack of planning by you does not constitute an emergency for me." 

If it is an A(6) loan (that is the paragraph of the Texas constitution that pertains to home equity loans) then you would NOT be able to get HELOC or Home equity because the Texas law says you can only have one cash out loan at a time. so, if your first is currently a cash out loan then you can not get another one.  

(Security) The Total Principal of the PPFP together with the PPSP shall be secured by a Deed Of Trust to be filed......any default with respect to either principal part shall constitute a default of the entire obligation outstanding at the time of default.

If so, that promise would constitute a prohibited transaction.

Then continue as to what constitutes default and actions required or taken.Okay, maybe my fees are a little too stiff, LOL  "delivered" means by hand by the tenant or their agent, by carrier pigeon, by electronic transfer, automatic withdrawls, U.S.

My own walkthrough legally constituted as an inspection due to how the contract was worded and I received my full earnest money deposit back accordingly.
