Some states have banned them altogether while others allow virtual auctions but not onsite auctions...and others have been mum on the issue.

It's important to note that many of the "appreciation markets" are banning evictions and not requiring tenants too pay for the rest of the year.

However, the CARES Act absolutely pulled the rug out from under landlords and overrides decades of landlord-tenant legislation and case law at the state level, as well as hundreds of years of basic contract law, by banning evictions for non-payment of rent for 120 days.Under this Federal Law, a tenant who stopped paying their rent in March would have no repercussions whatsoever until July 28th, at which time the landlord can issue a 30-day notice, wait the required 30 days, and then get in line to wait for a court date with an overwhelmed local court system in hopes of regaining possession of their rental unit.Even the best prepared landlord would have a very tough time weathering six months with no rent and no recourse.

Case in Point: Vacation rentals are currently banned statewide in Florida by the Governor as part of the pandemic response.Short term rentals are much more management and labor intensive (you are turning units over 50+ times per year on a weekly rental, compared to once every 1-2 years on a long term rental).

I know evictions are banned, but are we as landlords supposed to just forget about the rent that’s due?
