@Carolyn LorenceThe IRS rules prohibit any direct or indirect benefit between a disqualified party and an IRA or 401k - in either direction.If you create a joint venture where each side of the transaction is wholly separate and there is no commingling of funds, that would likely be OK.The potential issue is whether being enabled to participate in the transaction due to the presence of funds from a disqualified party would be viewed as a benefit by the IRS.

I did caveat my answer to state that different states are cracking down on wholesaling activities but to my knowledge, marketing a property you have under contract is legal.With that being said, the world of real estate investing is constantly evolving and I would be happy to be better informed on what law it is you are speaking about.The better to help my clients understand.

That 1% would give you a company that does nothing but focus on management and acquisition and keeps up in the fair housing laws that are constantly changing.Spending your time finding a good PM company is much easier than spending your time finding PMs, leasing agents, maintenance techs, and running the PM company.
