I feel like a $900 unit with a $75 flat fee for water will sometimes look better in an ad than a $975 unit with "free" water but that is just a judgement call on my part.For water I think the flat fee method works ok, because there is really not that much incentive to use up a ton of "free" water unless they are irrigating the lawn a ton.

As long as your lease terms are clear, you shouldn't have a problem getting the judgement in rent court.  

Roughly 4 dozen volunteer surrenders, a handful of judgements. 0 uncollected rents/funds.     

Private and secure: trustee is held harmless, beneficiaries can remain unknown, judgements against you do NOT attach to the trust; judgments against the trust property do not attach to you. 

I also know that - if proven - we stand to win a judgement higher than our fraud-related loss.I’ve been ready to go since the day we closed on the sale, and so - initially - was my business partner, once we confirmed that we have a case, and in what jurisdiction(s), based on terms of the contract and facts of the matter.

Some have chosen to divert from the point he was attempting to make in order to respond with self-righteous statements of grandeur and non-judgement of others.FYI- proclaiming yourself above the use of a word instead of just responding to the question isn't just self-righteous, its also very telling.There is a difference between people being firm in their beliefs and self-righteous, there is nothing wrong with being firm and confident...but if you really are then you don't need the "Shut up and listen to me" attitude that turns if from one to the other.I have found VERY FEW who are arrogant and stubborn are also successful and if they are telling you flat out thats how they are with their attitude on display, you should thank them for not wasting your time.

Vacancy doesn't hurt them much and actually can be a benefit with lease up fees so I'd trust their judgement. 

There you could make payments for 10 years only to lose it because the seller gets sued and the judgement attaches to 'your' property.
