This appears to not be a very tight knit agreement by any means or negotiated with an attorney, so its probably not gonna stand up in court for the builder and you have an out.

Now that I've publicly declared that I'm going to operate with zero vacancies, I cannot afford to be lazy just because I typically have a strong cash flow.

In this case, the easiest action to take is small claims court.

Do you know that after you win in court a writ of eviction, what happens next is mostly county policy, not state law? 

The big issues are the same as with auctions at the court house...clean title, tax liens, back taxes, and occupancy status.  

The judge ruled in my favor for both possession and money due (including court costs). 

For much of the time I could not as eviction court in this city was not even occurring.Because we have received the full benefit of the STR rentals prior to COVID, we are in a position to be able to absorb the $75K in lost STR rents. 

I would recommend doing the same, putting the ball in their court by making them aware of what needs to change really clears you of feeling bad when it doesn't work out and you have to walk away. 

If not, hopefully you have a professional finance company that will help you to get resolution.Going the legal route is always an option and depending on the ceiling with small claims court in the location of your STR, it is very inexpensive to file but you may need to have someone attend in your place - call the local court and ask for assistance and clarification.Finally, not trying to sound preachy but this is often what happens when you try to invest long distance and have to rely on people you do not know and do not know you. 

Because I refuse to invest in countries where foreigners are treated as second class, which could have dire consequences if I ever have to go to court for anything.Costa Rica is a different animal, where foreigners are treated equally and are allowed to own property freehold, which is the standard way of detention.
