It doesn't mean that line of thought will be successful, but it certainly would raise a sufficient line of evidence for them to have to oppose that maybe someone would change their thoughts....I'd also go and see if that original permit is still open and expired etc, could you 're-open' it under todays building codes?

That is the amount you sue for, that the judge will award.Then, you have evidence (the written scope of work to fix the problem and the cost) and you file a small claim for that amount.

When Subject To gets under scrutiny, the Subject To buyer had better have his facts and evidence in order and a nice reserve bank account and someone who knows their stuff with them.Cases like that can be brought even 6 years after the original contract (for most bank fraud crimes the SOL is 10 years), court can run a year and a half to litigate and cost $25,000 to $50,000 just in legal fees.
