Your LLC isn't functional until that is adopted, should have been done together with filing process.In the Operating Agreement, identify who has signature authority for binding the company, ability to incur debt in the company name, what limitations they may have, when it becomes necessary for both partners/members to sign or execute documents.

@Ali Boone What bothers me about what you do, is that you set yourself up as an authority on real estate investing and the various markets across the country, then try to steer people that live here in California, and are just starting out in investing, to other states, not knowing anything about who they are, their experience, etc.

I mean we are not a cheap area but if they are willing to go 75-80 miles away (Which Barrington, NH would be) for a suburb they could easily find a bunch of sub-$200K towns to find a real low price winner.Looks like the author is from Dallas so clearly has his finger on the pulse of this market!

There may be requirements to remove powers of a member or partner, this should be accomplished at notice, restricting signature authority to bind the company or tap any bank account.It may stipulate that a partner or officer may be represented by counsel to in any administrative action taken by other members or a board of directors.A vote may be required by a majority or some higher requirement to remove an officer.

My experience has been that on new builds (in my area) that property taxes are grossly under-billed in the first year or two because the taxing authority bases the taxes on a partially built or vacant lot for the first part of the year.
