If I finance the rebuild then the 1031 exchange presents some challenges (I will need to land a property that cash flows or breakeven so that I can get the loan for my rebuild, or banks will count that debt against me).

@William Burns we've managed thousands of S8 leases in our 24 years in business.The DHC has the most challenges, but it's NOT all their fault. 

Likely this will be tied up in court for a while.Then I would guess they would give everyone time to do it.If they win their challenge then you would never have to do it.

And, even then, hitting your rate target would still be extremely challenging unless you were paying points up front, in which case it would probably make more sense to just try to put in a bigger down payment (or pay down the balance if refi) instead and get better terms naturally offered at the lower LTV.
