If laws are put into place that diminish the enterprise to the point of break-even or unprofitability, I would sell out and my tenants would either be forced to leave as owners took possession or deal with landlords that are almost guaranteed to be worse than me.

You need to run the LLC as a totally separate financial enterprise or an attorney may be able to pierce the LLC and go after you personally (piercing the corporate veil)

Most people I know that are enterprising enough to go out and make something of themselves in real estate have enough drive that they would probably be successful in most anything.

I don't see any way for your Dad to avoid the early withdrawal penalty in addition to the ordinary income tax he would have to pay on an early withdrawal from his retirement account.You still have to decide if the money your Dad contributes to the enterprise is a loan or a contribution of capital.
