It becomes problematic due to callable loan threats or inability to get loans due to the LLC (although you can still just personally sign for them if eligible).However there are plenty of people with assets to protect who aren't in a a position where they need to borrow money and the corporate entity is preventing them from doing that.

The other thing that agents do is pay for things when the deal is close, but there is a gap that will prevent closing.

Supposedly there is a federal law to prevent this but not sure if the lenders get around it. "12 USC § 1701J–3 - PREEMPTION OF DUE-ON-SALE PROHIBITIONS" "(5)a transfer to a relative resulting from the death of a borrower;"I would hate to go through the probate process to change title and have them call it.

It may also require some boring into concrete and treating the interior walls by plumbing fixtures.You should seal up the exterior to prevent rodents if that has not already been done.

I would assume if the bank's loan agreement includes a clause that prevents the mortgagee from including the house in the BK filing, then all would be good in terms of me getting possession of the house, after winning at auction.
