Some CFDs are made with executed deeds, while some jurisdictions look at it as a race to the courthouse as deeds are effective when executed and perfected when filed, some Recorder's don't accept deeds made years ago.

You don't stop it just because you have a contract and no one is going to talk to you at the bank without it being listed on the MLS, fully executed purchase and sale agreement, disclosures, proof of funds, etc.
