If you don't think they will leave on there own, tell them you will put a judgement on them for all rent and damages then garnish there wages.

On May 8th I received a judgement for posession - they now have 10 days before the bailiff will physically evict them if necessary - I have also filed a police report - I will update as I know - any info sure would help.

If they don't pay for the repairs, yes I will evict and it will come out of their sec. deposit and/or money judgement anyway.They have plenty of time to speak with their lawyer regarding the validity of the charges during the lengthy eviction process.

Given that they could vacate at any time if they chose to, I don't see how making them this offer would be illegal, but perhaps I'm wrong on that.I don't know yet whether they filed chapter 7 or 13, or when the bankruptcy filing happened in relation to them being given an eviction notice (we do not have an eviction judgement though).
