The lease I use is a mature document that has been improved every year over the last decades based on issues that came up, after every major court case in Wisconsin etc.

If I'm reading this correctly, this is a serious mistake on your part and you could be sued for specific performance, meaning that a court will force you to honor the terms of the contract.  

You can take them to court and try to get the damages paid for. 

Anything I say, can and will be used against me in court. 

You can take them to small claims court, but are unlikely to ever see the money.

Now the home is technically in pre-foreclosure but there is no set court dates and they haven't received any letters or notices from the bank about them coning and taking over the property.

The seller's attorney has put forth a request to the court to allow us to buy the property and it looks like it's going to go through.

While the Insurance companies are reviewing this, I would give a careful read to the Bylaws and Declarations of the Condo Association to see who owns what in the building (decription of the unit for the boundries, definition of common elements/limited common elements, etc.) and if there are any clauses preventing one owner from going after another owner.
