I would read the contract very carefully and find out how payment is authorized - x% down, y% at completion of the work, etc.

With contracts or other documents you can have copyright issues, the contract may be owned by the author and they may use the contract to facilitate a sale which they oversee.

Without cooperation from someone in authority regarding the estate, a short sale can't be done.
