My advice below may not be accurate if it is "ANY financing" contingent.Daniel, send whatever rejection info (email letter etc) from your lender to the broker and tell them they have 48 hours to return the check or you are filing complaints with whatever relevant regulatory board there is in your state... and just in case it is one of those "holding the check and it isn't cashed or in escrow which some states do, call your bank and stop payment."

Although, I have had exposure to RE in four distinct ways: from a regulatory perspective during my time with the FDIC, from an underwriting perspective as part of a CRE underwriting team at BofA, from a public markets persepctive in my current role as an investment analyst, and as a homeowner for the past seven years.

Exclusions are Acts of God, insured perils, weather days need to be assessed to the season, lag time of suppliers or materials delayed or not delivered, delays caused by inspectors or regulatory matters beyond the control of the contractor, defective materials and/or equipment installed in the project, normal amounts of waste and other matters depending on the project.About all you can hold a contractor's feet to the fire on, is failure to continue work when work can be accomplished, their mistakes that exceed some agreed cut off (you will have mistakes and waste) worker's conduct or failure to show, work not to workman like standards or torts, such as walking off the job.

Those fines are not for minor infractions, they were probably in violation of key parts of regulatory requirements and repeated several times along with other minor infractions.
