Here in FL I have to send them a certified letter with a specific form stating that they bounced the check, the amount they owe, the service charge, etc and then they have 30 days to pay it or I can turn it over for prosecution.

Bottom line IMHO is read and fully understand your states requirements, insurance policies so they stay intact, and run the LLC as an LLC so that a prosecuting attorney cannot pierce it’s veil with a charging order or foreclosure on a member’s interest, by proving that you ran the LLC as sole propriety.

I would also suggest asking your lawyer to file a complaint with the Texas Attorney general, they are the ones who generally prosecute this type of action.

If the first comes and when the new rent posts she owes $601 with the late fee you get that eviction filed and prosecute it until she's either out or 100% caught up.The law here in Maryland is very unique in that we can take partial payments all the way up until the sheriff is at their door.

Because of the short statute of limitations, the investor was barred from prosecuting its ejectment lawsuit, and title vested back into the taxpayer and could be quieted!
