After reading this thread, a few comments come to mind over this common A or B decision.Without knowing how much it is (no need to say) makes my advice (or more accurately, my opinion) more general in nature but here it goes:Lending has very little to no tax shelters whereas buy and hold does.

But the 199A is scheduled to sunset in 2025 under the TCJA unless made permanent.It wouldn't be uncommon for some investors to only realize taxable income on 40-50% of their dividend distributions in today's current environment (I have seen this personally).You asked about fees, so one quick comment.

I always got the impression that he had a bad criminal record or never got his high school diploma/ GED equivalent or some other issue was preventing him from getting a license, because he was basically just brokering without a license but calling it consulting (I don't know any of that to be true for the record, that was just the impression that I got from his comments and might explain why he used a fake name?). 

Then, if you believe he made a mistake, come back here for a second opinion.Just one comment: you cannot carry anything back.

Ask the judge what criteria you have not fulfilled and if all is satisfied ask on record to have the eviction executed immediately and perhaps throw in a comment about failure to act providing damages.

And, comment to all, is there any ability to track these assets and see who owns the notes right now?
