There is a mandatory binding arbitration process in Alabama related to preservation improvements.

This means an arbitration by a third party takes place to see what is fair per the contract and events thus far as to who gets the deposit.  

But I would bet a contract involving custom windows involves arbitration and non-refundable hardware. 

If you think that his work to date is not properly performed and if you think you may have to go to court or arbitration eventually then you might consider hiring a local home inspector to document what he's done so far.

Another thing I have done is paid a lawyer to add an arbitration clause to the lease (except in cases of eviction, obviously).

@Sean Rooks Unfortunately, we've had a LOT of investors come to us after being screwed by their previous PMC:(The challenge is, most attorneys are going to want a $5k+ retainer fee to start a lawsuit.So, the price to recover a few hundred, or even a few thousand dollars, can get pretty steep.Also, check your PMC contract as many now have arbitration requirements.

There's usually a clause for arbitration, and if so, hopefully you can do that.

Usually it states that both parties agree to arbitration.
