The banks MAY call the loan due but it is not illegal to buy a property sub to the existing mortgage.You are correct, Subto IS legal, when done legally.Withdrawing money from the bank IS legal too, when done legally.Are you aware that when done improperly, Subto can lead to charges of Consumer Protection ACT violations, artifices, deception by omission, equity skimming, bank fraud, mortgage fraud, tax evasion and so on.

Lenders are lining up to provide down payment, “gap” financing, and earnest money deposit financing so that they, with no experience, no capital, and no knowledge can purchase a property they incorrectly analyzed as a good purchase, for “nothing” down.I agree with all but number 8, which requires some explanation.I am personally aware of a half dozen mentors/gurus that have made substantial amounts of money buying and selling real estate.

The new owner bought the house after I purchased my land, and he might not be aware of these encroachments.Is there any risk for me, such as the possibility of acquisitive prescription of a part of my real estate after years, especially if (theoretically) the neighbor incurs considerable expenses for e.g. asphalting his driveway?

I could have hired a pro, completed the work in under 30 days, and then collected five months of rent, which would have paid for the contractor and freed up my time.I learned a lot from the experience and don't regret it, but I'm aware of my limitations and more selective about what I take on.
