We look at tenants and try to make our best judgement on whether or not they will pay and take care of our property.

The court will look up the owner of the property before any sort of judgement to ascertain the owner of the property in the first place.

If the credit report shows no IRS judgements or forced payment plans, and two years of tax returns indicate they pay the IRS, it's really none of your business WHEN they pay the IRS so long as it is within what the IRS allows... which is the only thing that looking at those withholdings can tell you.Same thing when you call past landlords.

Given that they could vacate at any time if they chose to, I don't see how making them this offer would be illegal, but perhaps I'm wrong on that.I don't know yet whether they filed chapter 7 or 13, or when the bankruptcy filing happened in relation to them being given an eviction notice (we do not have an eviction judgement though).

As usual, its a judgement call.

Now, just because they ask about things that you don't allow in your unit (grilling outside, smoking, etc.) doesn't mean they'll be a pain, use your judgement.

I doubt a judge would side with you for a judgement or eviction when you are charging her for something she did not agree to pay.

The question there is, if we were awarded a judgement would she have the means to pay it.

She should be worrying about the judgement against her as part of the eviction as much as worrying about a suit from the person subletting.

The judgement here is ridiculous.
