I would venture to say that 95% of properties listed today on the market will not cash-flow at a 7-8% investment interest rate once you factor in principle, interest, taxes, insurance, and a maintenance / capex reserve.

You won’t end up in tax court but if you do, you would win based on everything you cited about material participation as long as you have a time and activity log that shows your tasks and provide a guest list that shows the number of nights your guests stay (easily found on the various platforms).

They generally have lists they can refer to.It's never 100% accurate because repairs on a newly bought building can quickly cascade into larger projects depending on what they find when they are on site.

So I was happy he provided me with an opportunity to buy the property without him going to a list of an internal list of preferred buyers which would have counted against me as a first time investor.I signed the purchase agreement then ordered an inspection report so I could perform extra due diligence as an investor.
