It says this is in the wholesaling forum so I assume you are a wholesaler.Attorneys can and will sue for opportunity loss on behalf of the seller.Does your contract say that the only remedy in full is forfeiture of the buyers earnest money as liquidated damages??

Escrow would also hold the original note and present it to me if the assignment is recorded.The escrow instructions would have to be clear about what’s a default, how it’s claimed, what the remedies would be before recording, and probably a hundred other things a lawyer could help you with.

The reason to do this is to get a base line so you'll have something to compare against when creating a deal with the seller.One path to explore is to see what her sales price is (if it's fair and agreeable) then subtract that amount from her balance on her mortgage and that would be her gross equity.

YOU can't do anything. except write up a unauthorized tenant living in unit as lease infraction. that will either be remedied by adding the new person on or booting everyone in the unit.The police won't force the new roommate out.Check landlord tenant laws for your state and comply with that.As long as current tenant gave access to the unit, it's the tenants problem not yours unless you press the unauthorized tenant issue.. as far as my experiences have shown.

If an actual inspection is done by the city, it's more than likely the illegal third unit will be discovered by the building inspector and would have to be remedied before getting the CCO, plus any fines that they may choose to issue retroactively.

I have 2 section 8 tenants and it's been all but impossible to get in touch with someone in the office there... one tenant is WAY under market rent and I'd like to remedy by getting them to increase their portion rather than having to evict and then re-place a tenant.
