Either work out the parking together or post a NO trespass on you part of parking area that's being trespassed,, paint with yellow stripe or something, and then tow the car that's there.Parking is at premium in a lot of areas so for him to take possession of your land use isn't something I'd let continue.

For example, her daughter works with you to remove the possessions, other family members could potentially sue you (just because the woman is her daughter doesn't mean that she is legally entitled to take the possessions out of the apartment).If it were me, I would check with an attorney, and at least give the family some breathing room (time) to take care of arrangements.

Not sure what the abandonment law is in NY but in AZ we have to post an abandonment notice for 5 days before taking over possession but with all the personal property gone and cleaned, I'd take my chances and proceed like @Nathan G. suggested.

If he fails to leave, then you file for eviction.I know weed is a misdemeanor but if he is smoking it "a lot" then there's a good chance he possesses more than an ounce which could turn it into a felony.

Amanda:Check your local tenancy law, but here an abandonment is a pain ... you know they are gone, but, unless they returned the keys, they are still in possession of the property and you must go through the eviction process to regain possession.

If it happens to you, and there does turn out to be some title defect that prevents your parents (or whoever owns the loan at the time) from taking possession of the property then remedying that problem will be YOUR problem instead of the title insurance companies problem.

Call you title agent now to see the condition of the title.Ask for possession before settlement to get a head start on repairs and rental. you should be able to get insurance as the equitable owner of the property - just show you purchase contract to the ins. co.Good luck and happy investing -
