Property is exempt from STR permitting because the jurisdiction considers it to be a commercial lodging establishment.We've been pursuing an SBA 504 loan for it, which was going well until we discovered that the sellers have operated it only part-time the last 12 years -- intentionally blocking 60% of available room-nights because they just weren't up for running it full time in their retirement.

They may/will not even look at the refi of a cash property unless you supply the HUD from the purchase which you do not have cause you haven't closed the loan.I think if you pursue this you are heading toward headache land and you may possibly screw yourself.

However, if you move too fast you could get into the wrong property, or area, or not take into account certain expenses, or get a terrible tenant and you may say this real estate thing is a huge headache and not worth the hassle and you may not pursue it with as much vigor going forward, or worse throw in the towel altogether.

The Attorney Generals office which was tasked with this, and already had a guidance memo that wholesaling was unlicensed brokering, did not have the resources to pursue the subject.So by requiring that the act requires a license, shifts the burden of enforcement primarily off the AG's office and to the MREC, who has a narrower of focus of protecting the public in matters regarding real estate.
