Seller financing is an equity based loan, look to the UCC as to default of installment contracts, they become void, points or loan fees are not charged on equity financing.......I said not charged when I should say, should not be charged as I'd bet sellers are not in compliance, they can just lose their note and suffer any consequence that goes with unlawful lending.

ASSUMING the tenant has communicated with all correspondents, it will get resent properly.otherwise, it dies with the originator and you have no responsibility for the consequences.

Did you enforce whatever consequences there may be when the first tenant was late, the first time.My best advice is you have to enforce the lease and make sure your manager is enforcing the lease too.It's your business, your investment, you need to respect it so other respect it too.

Not the worst thing but it does leave you with a tax bill and it also slows you down.As long as you perform a 1031 exchange when you sell the Parker property, which you can do right now, you'll be able to move it with no tax consequences at all into whatever market you choose.
