Yes, the case mentioned seems to favor the one with legal title as opposed to the claim of an equitable interest. 

All of the properties have 25%+ equity and mortgages with Quicken Loans (refinanced recently with very favorable rates). 

Calculate the best you can and roll the dice if the odds are in your favor.    

If it was me, unless I had some cash savings that would cover an unexpected event, I would probably pass if the numbers weren't clearly in my favor...

If it's local or regional sometimes they will finance the property at favorable terms while you turn it around.This will help keep your cash to put into the property versus a large down payment.

You are correct that the terms of commercial are not going to be nearly as favorable as conventional and the balloon in 5 years is always hanging out there.

While I'm not certain what the exact cut-off is that technically classifies a babysitter from a daycare service, I'm willing to bet that a friend of the tenant staying with her daughter to watch both children while the tenant is at work won't check enough boxes to convince a judge/jury to rule in your favor here.With that said, I always recommend calling your insurance provider and ask how THEY view arrangements like this and what liability it may be imposing upon you.
