Also I think you are not serious when you say that - if a home owner doesn't want to down pay it means they didn't have money :-)I am not an expert and definitely the other experts can provide better practical ways to protect your down payment , But try asking for insurances , last 3 references , a contract with a tight scope of work , any judgements/ official complaints .I don't know for some weird reason as soon as I ask for half of these , they stop responding .

Putting in the years apprenticeship to get to the point where you have the expertise, knowledge and judgement to be trusted with other people's money doesn't interest them.

Collecting on a judgement for the now $6700 in back rent may take a while, but I think it could be done OR I can risk the tenant messing up her application (or no longer being eligible) a 3rd time and waiting another 6+ weeks (and another month or two of missed rent) for nothing.

I would still charge the security deposit and not let our super stupid idiots at the city council deter me from collecting a security deposit and paying your tenants a stupid 1% or $10 for a $1,000 security deposit.If you are so worried about being $1.00 off and getting fined be the best landlord in town and give your tenants $20 every year and they will think they died and wen to heaven.As for not getting a security deposit and suing for damages, you can't squeeze blood from a rock and I found it is cumbersome, time-consuming and expensive to take a tenant to court and win, go to court a second time for an appeal and win and go to court two to three more times to do discovery for your tenant's assets to try to collect on your judgement and still not get one penny.

I mean they made a decision to be a lawyer in the first place which makes me question their judgement already.

And before the judgement comes down, this was a relationship over 3 years old, lots of history and they had actually basically become friends of mine.

Eviction processes are nasty as it would create a judgement against you from a court requiring you to pay me the money owed, plus damages, and you would have that placed on your legal record preventing you from renting in the future and taking out any favorable loans.It's up to you BLAHBLAHBLAH, get back to me.Eric

He said the owner trusts his judgement and will go with his recommendations, so he and I are going back and forth on the terms and not once he has to "check with the owner".I guess in South Florida I run into this every corner I turn LOL.
