I highly doubt the parties considered storage, living arrangements, interest, utilities, etc. as a potential remedy for a breach at the time they contracted.Also, you don't "make a claim against E&O".

Well, I went ahead and did my due diligence on the property by getting certified mold remediation costs, and then estimated rehab costs on my own (again, I'm a newbie) based on what demo/remediation was necessary, and lastly verified these estimated costs by getting estimates from 2 different GC's in the area.

My thoughts/fears are, if I pay the rest of the bill then they will not be motivated to fix or remedy this.I feel awkward saying, "I won't pay you until after this is done", but that feels like the safest bet for my own best interests.

Until the city comes up with a REASONABLE solution to the inspection issue most will choose to thumb their noses at the requirement.So you think you should be allowed to rent units to tenants with lead based hazards because remediation will screw up your profits?
