Yes you can but it depends on the lender some lenders do not allow due to overlays and in house restrictions.

There's nothing you will be able to do unless the heirs agree to go through probate to get ownership of the property and then sell it to you.

If the lender is licensed in the state you're buying in, then they can do the loan.
