Can Seller 1031 into a new partnership with buyer of old property
30 May 2018 | 14 replies
@Daniel DietzPerhaps you can have Frank put the 300k down and take out a 300k loan to purchase the property and then shortly thereafter cashout refinance it at 75%ltv (450k).This would allow you to return 150k to Frank.By structuring the transaction this way, Frank will have access to the cash he wants while enabling him to defer taxes on the whole 300k.I believe this would be a permitted transaction but I'm not an expert on 1031 so you should definitely double check with @Dave Foster.

Two Hundred Thousand Dollar Question

The emotional value she has knowing that we own a rental property free and clear (cash flowing $1000/month) with no debt owed to anyone (aside from county taxes) trumps leveraging that asset to acquire additional properties.Thankfully, the cashflow from that asset and our other properties will enable us to save the 20% down payment on another SFH by the end of the year when the local market cools down a bit.

I would like to use my past real estate experience along with my degree to build a family real estate investment business to enable my husband to leave his current job to work along with me and pass along to my son one day.I am a big fan of forums and of networking so I look forward to meeting so many of you online and maybe even get the opportunity to FaceTime or Skype to share professional experiences.I enjoy helping others so if there may be any questions that I can answer for you especially in the area of property management which is a strength of mine, please don't hesitate to ask.

Make it clear that their failure to perform inspections enabled the problem to worsen and they are therefore liable. If they refuse to pony up, you can file a complaint with their Broker and then the real estate commission or whatever your governing body is for California.
