@Charles Heyligen Depending on credit quality, debt service coverage, global debt service coverage, net worth, size of loan you can get 25 year pretty easily and maybe even 30 year if it falls into agency debt ( Fannie Mae/Freddie Mac).

The advice you already received to engage an attorney is something you should follow.Writing checks on a closed account is a criminal offense - see if the county will prosecute this tenant.What sort of screening process did you use on this tenant before you let this tenant move in?

No offense to @Nick Vehr here at all but a professional property manager has the correct wording in their application legal disclaimer, the reservation deposit agreement and their lease so that a tenant who fails to move in wold absolutely forfeit any monies paid.
