The lender will have some procedure for getting the checks endorsed.

In Oregon, we also have an abandoned property procedure.

There are even local rules of court (which affect procedure, not statutes). 

They do not create policies or procedures to ensure their success.

Think you have to deal with it with procedures/rules rather than excluding them.
