Brian and I have discussed this aspect and I believe he doesn't make that claim, as any agreement to sell creates an equitable interest for the buyer, think as we justifiy flipping contracts to wholesale deals.IMO, that attorney needs to go back to school and he certainly needs to review lending requirements before he attempts to devise some spinoff contract for investors, not sure what the attorney's motivation was, fame or fortune, or both, but I doubt he'll be looking at fame in a positive light.
