Rather than getting into a defensive mode I made it clear that I was flexible and willing to negotiate and fortunately the tenant was taking a reasonable tact as well, so it was a win/wing all around.

You want to make it painful enough (like a parking ticket), but also not so much that it puts them in  'fear' mode.  

So while I did not use a deposit slip my account currently has a lot of this vapor money that I can access for whatever I desire (I have been considering a Tesla with Ludicrous mode 😀). 

But as one of the OP mentioned if your intention is to subdivide this and you have all these neighbors close to you.. then you need to go into mediation mode and make sure you have them as allies and not enemies they can cause you far more harm in the land use process than simply bugging you about walking on your property.. the cost of perfect some silly  right to walk on your property is far more than anyone is going to spend in the real world unless your land locking them.

Hey Nick, after reading through all of these replies back and forth I couldn't agree more with Albert Hasson meaning you're starting to go into Analysis Paralysis mode. 

The fact is that most people now communicate by email and tenants seem to prefer this mode of communication most of the time.

Puts it in the hands of a judge, which I wouldn't be afraid of, and also doesn't let the tenant get into bully mode.  

It really has a lot to do with your area and your business model.  I

In those situations the returns are reduced though for extra security and ease of headache.This is why I am bullish on retail personally and my clients as well as myself individually are in purchasing mode for 2015.
