Check the document that property's state has regarding tenants' rights: in the state I invest in, it says that withholding rent for landlord disputes is illegal.

It will depend on what the bank seeks in its resolution, and what the judge determines.

Did the seller know that the "New" lease existed or is it possible the tenant produced a forged document knowing the seller wouldn't be around to dispute it?
