All probate laws, procedures and, of course, forms are local to your state.Here in CA, they've made it easy by including a checkbox on the face of the Petition for Probate (of decedents estate) form. 

(b) If the records of a series are maintained in a manner so that the assets of the series can be reasonably identified by specific listing, category, type, quantity, or computational or allocational formula or procedure, including a percentage or share of any assets, or by any other method in which the identity of the assets can be objectively determined, the records are considered to satisfy the requirements of Section 10A-5A-11.02(b)(1).

List of suggestions.1) Be familiar with the eviction process2) Observe Disp. court prior to even filing3) Follow proper eviction procedures for your jurisdiction and do not request more than you can reasonably expect.4) Double and triple check court time and location.5) Make required copies for all paperwork you are going to give to the judge.

They also will handle eviction procedures on your behalf (legal fees are not included).

If you can get that judgement, then I'd imagine you could start to garnish his wages, depending on the laws and procedures in your area.
