I.e. claiming transaction was a lease with option to buy.It should be noted that I filed a Chapter 13 Bankruptcy trying to keep the buyer in the house but the buyer refused to pay the Bankruptcy Court.

With theirs they take all issues and instead of figuring them out and clearing them they just put them under the exceptions and you are stuck with the issue e.g. title is not ensured against the bankruptcy that was filed by the owner or for the construction lien filed against the property.

I'd do a short sale, I'd do a bankruptcy and take a borrower who had other serious credit issues, but walking away when there are other options just smacks me with gross irresponsibility, why would I contract with someone who has demonstrated that they don't care about contractual obligations?

Let the seeler know it's this attorney guy screwing up his deal, that if it is in default it could go to foreclosure, an attorney will take him to bankruptcy, prolong the agony and in the end, credit will be worse, the house will be gone and the attorney will be richer!
