I would hope we go into business with people we trust, but still we usually outline how things should go in the event of things going south as it is easier to compromise fairly when everyone is levelheaded, rather than after the fact when emotions are on the line.

If not, or if the CA property compromises your ability to get a mortgage generally in NC, that would be an incentive to sell.It sound like you wouldn't see much in capital gains, so that doesn't influence your decision making.Personally, I think N.C. is a better market for cash-flow properties.

It has come to my understanding that if you don't account perfectly for expenses, a lawyer can argue that the LLC ultimately leads to me and my husband, and that our personal assets would get compromised anyway.

In your example of $120,000 current tax value and $70,000 purchase, they might come back with an $80,000 or $90,000 value as a compromise.
