Since the bank knew about the sellers' retained interest, if it wanted the title policy to insure it against possible loss caused by the interest, the bank should have asked for affirmative coverage, which I'm pretty sure the insurer would have declined to provide.Now I haven't read the pleadings or seen the evidence, but I suspect the bank may have had significant defenses to the Sellers' claim of priority.
