Is the date that I put the property in service conflicting with the date of the repairs and expenses going to be an issue and throw up red flags for the IRS?

If I were the third floor tenant, I would not want incense  or scented candles coming into my apartment, either, as I am very sensitive to smell, but taking it to the level of threatening  a discrimination suit due to allergies is a huge red flag that you should take seriously. 

I would be asleep in my bed until 8am, at which time I would tape a large 8.5" x 14" piece of yellow paper to his door with the word "TRESPASSING NOTICE" in big bold letters at the top and the details of breach and criminal trespass below.
