The remedy that a Mortgagee has for default is foreclosure to recover their principal.

In the event the Seller is not able to (a) make the title insurable or correct any problem or (b) obtain title insurance from a reputable title insurance company, all as provided herein, the Purchaser may terminate this Agreement and any earnest money deposit will be returned to the Purchaser as the Purchaser’s sole remedy at law or equity.

It will depend on how much it costs to remediate the problem as opposed to how much the asking price is.

If he cares about his voters he will call code enforcement and get them to issue the owners a citation that they need to have everything remedied within usually 7 days.  

I am just getting owners in contact with other owners to find out what they can do to remedy the situation.

From my experience, (I invest out of state for cash-flow to lower income families) this deal looks like it won't cashflow, and you'll have some out of pocket costs to remedy operating expenses and debt.

Subject to inspection & approval Subject to appraisal acceptable to BuyerIn event of buyer default, deposit is sole remedy/ are the clauses I utilize.

If you have done work on the home and haven't gotten paid ... small claims court is a good remedy.
