I agree with you and will add this to the Starting Out forum, however did this because once people have the rhythm, they do not check the Starting Out forum, and vice versa, newbies might not check outside the Starting Out forum.The intent of this article is to give food for thought into the process in general - and I wanted everyone to be able to find this no matter their experience.

If you start with a 12 month lease and they are good tenants then great, but if they are bad tenants you can terminate the tenancy with 30 days notice and be rid of the problem.2) The President of our REIA firmly believes, and I agree, that each time you go sign a new lease it just reminds the tenant of how long they have been renting from you. my goal is to have as many long term tenants as possible, so I don't want to continuously remind them of how long they have been renting one of our properties.

I still don't know the right question :-) but I am happy to know that the answer is "the taxpayers must be the same" and that there can be circumstances where a disregarded LLC can 1031 to personal name and vice versa.
