They can prevent it if you don't live there too, but as long as you live there, it's permissible.

If there are permissible places to smoke, you need to make sure that it is clear in all paperwork & advertising. 

If it helps I have a forum post along the same lines what I basically got from it was that in my case the animal was Brought onto the property without permission and when asked to remove the dog the tenants got the dog linked to an emotional support animal which you can do online for a fee.

Now you need to disclose to your agent your intentions and get written permission from the seller to assign the agreement.

I have seen some post shading wholesalers and want to know What exactly the issue is if you get permission from the property owner and technically under contract as the home owner.

If someone really likes the apartment and they meet your pre-screening requirements, then ask for permission for a live tour from your tenants. 

If it's a really juicy deal on a property that I badly want, I ask the listing agent's permission first to put them as the buyer's agent (never had one tell me "no", but it's polite to ask first).
