So even if you had a buy out agreement negotiated up front and execute that buy out agreement, the bank would still require him to be guarantor unless something drastic changed on your side financially.The best scenario here would be to purchase and rehab the property using a hard money lender or bridge lender.  

So if I do a good analysis of the property (including all the costs) and the property generates monthly CF with a DSCR above 1.1, I would be removing a big risk because the numbers add up.

We have found it for number years so the value of the property has went up plus I did an extensive rehab.I owe about 215 not counting the last rehab that was about 60 K out of pocket.

They recently split up and the wife is asking to be removed from the lease agreement.

So I didn't cash in any fund investment to buy notes. 

I'm have been asked to enter into a partnership with an experienced investor, and I'm not sure how to or the best way to structure a partnership.
