I think your next stop is a CPA, specifically one who can give you a "lens" on your overall financial picture and can understand the "nuances" to balance your goals. 

Of course, we're currently looking at these asset classes through a very different lens than 6 - 8 months ago, and people will always need a place to live.

If you change the lens and think of this like a commercial agreement where the tenant is improving the property for their business purpose then it starts to make sense at least in my mind.

Presently that could be anywhere from 4% to 12% in interest and between 0.5% origination and 5% origination fees (again thinking through the lens of Private Money being between HM and Mortgage loans).With duration you'll again see a LOT of variability.   

As far as what these CC&Rs say I think you're looking at this from the wrong lens.
