According to the theory, because you took possession unlawfully, you are not entitled to be paid for improvements and might even be liable for damages for trespass.I am not saying this is how the lawsuit will go.

“If the landlord makes an unlawful entry or a lawful entry in an unreasonable manner,” then the tenant may go to court to “obtain injunctive relief to prevent the recurrence of the conduct or terminate the rental agreement” and, in either case, “recover actual damages not less than an amount equal to one month’s rent” (A.R.S. 33-1376(B)).

You wont be able to evict unless the lease is up or they are month to month. 2) I am not sure of your local laws, but in MN we cannot evict right now unless there are unlawful reasons and they are a danger to others (this at least was the last I heard for our laws).

I had seen something similar as far as landlords paying damages to tenants for an unlawful or retaliatory termination of the lease.
